Multi Million-Dollar Lawsuit Won By A Woman Whose Baby Was Pushed Back In By A Nurse During Delivery

Whoa! Some stories seem ridiculous, but you be the judge for yourself. Brookwood Baptist Medical Center in Birmingham, Alabama will have to pay out around $16 million after they lost a lawsuit filed against them by Caroline Malatesta and her husband J.T. The couple claimed the nurse purposely tried to delay the birth of their child by pushing the baby back in. What a freaky nurse!


Brookwood was the hospital of choice for the couple to have their 4th child was because it promoted natural childbirth with the ability to walk around during labor, plus access to wireless fetal monitoring and birth tubs. Of course it advertised this rather fancily to attract patients. The Malatesta’s also said that they also chose the hospital because of their previous unpleasant experiences with the other 3 children.

Apparently the Malatesta’s baby came earlier than expected, the doctor was not on call when her water broke. The nurse on duty tried several ways to postpone the labor by telling Caroline to stop pushing. This is not as easy as it sounds. She also denied Caroline’s request to be in a more comfortable position on her hands and knees, the nurse forced her to lie on her back. Since the doctor still was not there, the nurse did the ghastly act of literally pushing the baby back inside to keep it from being delivered! This went on for about six horrifying minutes until the doctor finally arrived. The baby was born the minute after.


The baby was fine, but Caroline suffered nerve damage in the genital region known as pudendal neuralgia, not to mention the trauma caused by the unprofessional nurse. Her pain is worse than labor pains, as she has to endure constant pin-and-needles pain and a burning sensation that almost never goes away. In the beginning it was so severe that she had to move back to her parents’ house for full time nursing. The severe pain made her rest most of the day or take baths.

It is a good thing the Malatesta’s had a good lawyer, but what kind of nurse can’t deliver a baby? Surely that should be part of basic emergency training just like CPR. It’s a pity that some people have to suffer at the hands of incompetent people. This is plain ridiculous.
