Supporters of Bernie Sanders in Massachusetts have officially filed a lawsuit against Bill Clinton for engaging in illegal activities on the day of the Massachusetts primary to help his wife win the state.

A group called MA Sanders Voters and Volunteers Disenfranchised by Bill Clinton filed the lawsuit after gathering evidence against the former president to use in their case, alleging that he illegally campaigned at polling stations, sometimes even going inside.

The MA Secretary of State Galvin was seen posing with Clinton and chatting with him at one event and defended him by saying his presence was totally legal because he wasn’t saying “vote for Hillary” or anything of the sort.

The lawsuit addressed this and said that this notion is “beyond absurd,” as “his very person, the presidential candidate’s fabulously famous husband, amounts to a walking, talking sign for Hillary.”

Additionally, there is video footage of Clinton saying into a microphone, “I especially thank those of you who are supporting Hillary.” He also called himself “the husband of a soon-to-be great president,” to which some of the crowd cheers.

Massachusetts law states that no one may campaign for any candidate within 150 feet of a polling station, but Clinton was documented through videos and photos as having even entered the premises. The lawsuit points out that in another video, Clinton apologized to the audience for being so hoarse because he had been campaigning all day.

The group states that, “By the end of the day Hillary Clinton had eked out a narrow victory by 1.4%, which represented about 16,800 votes. The narrow victory in this closely watched race, deemed “critical” for each candidate, bolstered the Clinton candidacy in future primaries, making this a live and active issue to the present day.” Bill Clinton’s presence likely compelled some of the undecided voters to vote for Hillary and his rallying may have even swayed those who arrived with the intention of voting for Bernie, as the places he campaigned at were mostly favorable towards Bernie.

Hillary won 63 of the delegates and Bernie won only 46 because of that one percentage point difference. Even if Bernie had won the state, the lawsuit cites the Silverthorne Lumber Co. v. United States as an applicable doctrine to their case. The original case found that evidence obtained illegally from a suspect by police must be thrown out and cannot be used in court. Similarly, the lawsuit claims that votes obtained illegally in this Massachusetts primary should not count towards Hillary and, instead, all of the delegates she was awarded should be given to Bernie.

If this lawsuit were to prevail against the Clintons, it would cut the decreasing lead Clinton currently has over Sanders significantly. Of course, this lawsuit won’t be met without a fight from the Clintons, but perhaps coverage of the suit could persuade future primary voters not to vote for Hillary if they relate her and her husband with fraudulent activity.
