Madison's birth mother has filed a lawsuit against the State of Arizona for the trauma suffered by her daughter.
Madison is a little girl who was terribly failed by the government agencies that exist to protect her. Madison’s first foster father is now a convicted pedophile, and her second adoptive mother abused her so badly that Madison is now permanently disfigured.
Madison’s birth mother, Michelle Tremor, has filed a lawsuit against the State of Arizona, on account of the trauma suffered by her daughter, during her time in the care of the Arizona Department of Child Safety (DCS).
Throughout the United States and all over the world, there are millions of children and babies that have been orphaned, or must be removed from their homes due to abuse. There are systems in place to care for these children, but these institutions are almost always dependent on very limited government funding.
As a result, social workers are overworked, underpaid and subject to a heavy emotional burden. As another result, and considering the lack of good home available, children have mistakenly been placed in the care of dangerous criminals.
Such is the case of little Madison. Madison was born in 2011 as “Devani” to Michelle Tremor. In April 2013, Madison was removed from her home by the Arizona Dept. of Child Safety, on account of her parents’ drug use and domestic violence.
DCS placed Devani in the home of foster parents David and Barbara Frodsham. The Frodshams had been maintaining a state-licensed foster home since 2002. David Frodsham was removed after being caught for a DUI with children in his car — one of whom was Madison. The next year, David Frodsham was arrested and accused of “sexual conduct with a minor, and conspiracy to commit sexual conduct with a minor and sexual exploitation of a minor.”
KVOA News 4 Tucson reports Madison’s birth mother Michelle had insisted the child was being abused in the Frodsham home. “I told my CPS/DCS caseworker on several occasions due to my concerns, and they were all ignored,” Tremor said. Tremor reported Madison experienced constant urinary-tract infections, which can be a sign of repeated sexual abuse in children.
The lawsuit claims DCS reacted by, “Instead of investigating Jane Doe’s biological mother’s concerns of abuse, [DCS] and the defendant caseworkers accused her of making false and exaggerated reports to DCS.”
Little Madison’s story then took a turn for the worst. Following removal from the Frodsham home, Madison was adopted by 28-year-old Samantha Osteraas, and her husband Justin. Devani was then renamed Madison.
On December 29, 2016, “Defendant Samantha Osteraas submerged and held down Jane Doe, a 5-year-old, in a bath of scalding hot water. Jane Doe suffered severe burns over 80 percent of her body.” Samantha Osteraas is free on a $25,000 bond and faces two charges of child abuse.
